1. Acceptance of Terms

By downloading, installing, accessing, or using Aesthetics AI ("the App," "our App," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms," "Agreement"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Aesthetics AI. Please read them carefully.

2. Description of Service

2.1 What Aesthetics AI Does

Aesthetics AI is a mobile fitness application that:

• Analyzes physique photos using artificial intelligence (AI) technology
• Provides physique ratings and scores (0-100) for overall physique and individual muscle groups
• Generates personalized workout plans (splits) based on your physique analysis
• Tracks your progress over time by comparing scans
• Provides feedback and recommendations to improve your physique

2.2 Service Limitations

• The App provides informational and entertainment purposes only
• AI analysis is based on visual assessment of photos and may not be 100% accurate
• Results are estimates and should not be relied upon as medical or professional assessments
• The App does not replace professional fitness coaching or medical advice

3. Eligibility

3.1 Age Requirement

You must be at least 13 years old to use this App.

If you are under 18:

• You must have parental or guardian consent to use the App
• Your parent or guardian must agree to these Terms on your behalf
• Your parent or guardian is responsible for your use of the App

3.2 Legal Capacity

By using the App, you represent and warrant that:

• You are at least 13 years old
• You have the legal capacity to enter into this Agreement
• You have obtained necessary parental/guardian consent if under 18
• You are not prohibited from using the App under applicable laws
• All information you provide is accurate and truthful

3.3 Prohibited Users

You may NOT use the App if:

• You are under 13 years old
• You are located in a country where the App is prohibited
• You have been previously banned from using the App
• Your use would violate any applicable laws

4. Account and Subscription

4.1 Account Creation

• You must sign in with a valid Apple ID or Google account
• You are responsible for maintaining the security of your account
• Do NOT share your account credentials with anyone
• You are responsible for all activities that occur under your account
• Notify us immediately if you suspect unauthorized access

4.2 Account Requirements

• You must provide accurate and complete information
• You must keep your account information up to date
• You must use your own photos (not photos of others without consent)
• You must comply with all applicable laws and regulations

4.3 Subscription Service

Paid Features:

• Certain features require a paid subscription
• Subscriptions are managed through the Apple App Store
• Pricing and billing terms are provided at the time of purchase

Subscription Types:

• Weekly Subscription: Billed weekly, auto-renews
• Yearly Subscription: Billed annually, auto-renews
• Lifetime Purchase: One-time payment (if offered)

Auto-Renewal:

• Subscriptions automatically renew unless cancelled
• You can disable auto-renewal in your Apple ID settings
• You will be charged before each renewal period
• Cancellation takes effect at the end of the current billing period

4.4 Free Trial

• Free trials (if offered) are available once per user
• You will be charged automatically after the trial period ends
• Cancel anytime before the trial ends to avoid charges
• No refund for unused trial periods

4.5 Pricing and Payment

• Prices are displayed in your local currency
• All payments are processed by Apple through the App Store
• We do not store or process payment information
• Apple's payment terms and refund policy apply

4.6 Refunds

• Refunds are subject to Apple's refund policy
• Contact Apple Support for refund requests
• We do not process refunds directly
• Refunds are at Apple's sole discretion

4.7 Subscription Changes

• You can upgrade, downgrade, or cancel your subscription at any time
• Changes take effect at the next billing cycle
• No refunds for partial subscription periods
• Cancelled subscriptions remain active until the end of the paid period

5. Acceptable Use

5.1 You Agree To:

• ✅ Use the App for personal, non-commercial purposes only
• ✅ Provide accurate and truthful information
• ✅ Use your own photos for scans (or photos you have permission to use)
• ✅ Respect intellectual property rights
• ✅ Follow all applicable laws and regulations
• ✅ Use the App in a safe and responsible manner
• ✅ Report bugs, errors, or security issues to us

5.2 You Agree NOT To:

• ❌ Upload photos of other people without their explicit consent
• ❌ Upload inappropriate, offensive, or illegal content
• ❌ Upload photos that violate anyone's privacy or rights
• ❌ Attempt to reverse-engineer, hack, or exploit the App
• ❌ Use the App to harm, harass, or impersonate others
• ❌ Share or resell your account access
• ❌ Scrape, mine, or extract data from the App
• ❌ Use the App for any illegal purpose
• ❌ Interfere with or disrupt the App's operation
• ❌ Create multiple accounts to circumvent subscription requirements
• ❌ Use automated systems or bots to access the App

5.3 Content Standards

Photos and content you upload must:

• Be your own or used with permission
• Not contain nudity or explicit sexual content
• Not violate any laws or regulations
• Not infringe on anyone's rights
• Be appropriate for a fitness/health app context

We reserve the right to remove any content that violates these standards.

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of photos and content you upload to the App.

However, by uploading content, you grant us:

• A license to use, store, and process your photos to provide the service
• A license to use your photos for AI improvement (if you opt-in)
• The right to display your content within the App
• The right to generate derivative works (analysis results, workout plans)

6.2 Our Content

All App content is owned by Aesthetics AI, including but not limited to:

• Design, layout, and user interface
• AI models, algorithms, and software
• Text, graphics, logos, and branding
• Workout plans and recommendations
• Analysis results and scoring systems
• Documentation and help content

6.3 License to Use

We grant you a limited, non-exclusive, non-transferable license to:

• Use the App for personal, non-commercial purposes
• Access and view your own data and analysis results

You may NOT:

• Copy, modify, or create derivative works
• Distribute, sell, or sublicense the App
• Reverse-engineer or decompile the App
• Remove copyright or proprietary notices
• Use the App for commercial purposes

7. User Responsibility for Safe Use

You are solely responsible for:

• ✅ Using the App safely and appropriately within your abilities
• ✅ Following workout recommendations at your own risk
• ✅ Stopping exercise immediately if you experience pain or discomfort
• ✅ Seeking medical attention for any injuries or health concerns
• ✅ Modifying or discontinuing exercises that feel unsafe
• ✅ Using proper form and technique (consult a certified trainer if unsure)
• ✅ Not exceeding your physical limitations
• ✅ Consulting healthcare professionals before starting any fitness program
• ✅ Making informed decisions about your health and fitness

8. Disclaimers and Limitation of Liability

8.1 "AS IS" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy, reliability, or completeness of analysis results
• Fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation
• Security or freedom from viruses or malware
• Compatibility with your device

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AESTHETICS AI SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Personal injury or property damage
• Damages arising from use or inability to use the App
• Damages arising from reliance on AI analysis or recommendations
• Damages arising from third-party services (OpenAI, Supabase, etc.)

Maximum Liability:

Our total liability to you shall not exceed the amount you paid for the subscription in the past 12 months, or $100, whichever is greater.

8.3 Injuries and Health Issues

We are NOT liable for:

• Injuries sustained while following workout recommendations
• Health complications arising from use of the App
• Decisions made based on AI analysis
• Reliance on physique ratings or scores
• Failure to consult healthcare professionals

Always consult a healthcare professional before starting a fitness program.

9. Third-Party Services

The App integrates with third-party services:

• OpenAI (AI analysis)
• Supabase (backend infrastructure)
• RevenueCat (subscription management)
• Mixpanel (analytics)
• Sentry (error tracking)
• Superwall (paywall optimization)
• Apple (authentication, App Store)
• Google (authentication)

We are not responsible for third-party services or their actions.

10. Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your data.

11. Termination

You may stop using the App at any time by deleting the App from your device or contacting us to delete your account.

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, upload inappropriate content, or abuse the App.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via in-app notification, email (if provided), or updated "Last Updated" date.

Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Dispute Resolution

These Terms are governed by the laws of New Jersey, United States, without regard to conflict of law principles.

For disputes that cannot be resolved informally, binding arbitration shall be used (except where prohibited by law), conducted under American Arbitration Association (AAA) Commercial Arbitration Rules in New Jersey, United States.

For small claims (under $10,000), you may use small claims court instead.
